Terms of Service

These Terms of Service ("Terms") govern your use of the Anthe mobile application ("the app", "Anthe", or "the Service"), developed by Frederik Gielsen ("we", "us", or "our"). By downloading, installing, or using Anthe, you agree to be bound by these Terms.

1. Description of Service

Anthe is a garden management application that helps you document and manage your outdoor spaces. The Service includes:

• Garden and plant journaling with photo documentation
• AI-powered plant identification from photographs
• Seasonal gardening guidance tailored to your climate
• Plant health monitoring and care recommendations
• Cloud synchronisation of your garden data across devices

2. Account Registration

To use Anthe, you must create an account using a valid email address or Apple Sign-In. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the security of your account credentials.
• All activity that occurs under your account.

You must be at least 13 years of age to create an account and use the Service.

3. Subscriptions and Payments

Anthe offers a free tier with core functionality and a premium subscription ("Anthe Pro") with additional features.

• Monthly plan: £4.99 per month
• Annual plan: £39.99 per year
• Free trial: New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin automatically.

All subscriptions are managed through Apple and are subject to the Apple Media Services Terms and Conditions.

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your Apple ID account settings.
• Refunds are handled by Apple in accordance with their refund policies.
• Prices may change from time to time. We will notify you in advance of any price increases.

4. User Content

You retain full ownership of all content you create within Anthe, including photographs, journal entries, garden notes, and any other materials ("User Content").

By using the Service, you grant us a limited, non-exclusive licence to store, process, and display your User Content solely for the purpose of providing the Service to you. We will not share, sell, or use your User Content for any other purpose.

Your User Content is not shared publicly. Only you can access your own gardens, plants, and journal entries.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Reverse-engineer, decompile, or disassemble the app or its underlying technology.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated systems (bots, scrapers) to access or interact with the Service.
• Upload content that is malicious, harmful, or infringes on the rights of others.

6. AI Features Disclaimer

Anthe includes AI-powered features such as plant identification and health/disease diagnosis. These features are provided for informational purposes only and should not be relied upon as professional horticultural, botanical, or agricultural advice.

• Plant identifications may be inaccurate, particularly for rare or unusual varieties.
• Health and disease assessments are indicative and should not replace consultation with a qualified horticulturist or plant specialist.
• Seasonal care recommendations are general guidance based on your approximate climate zone and may not account for specific local conditions.

We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You use these features at your own discretion and risk.

7. Intellectual Property

The Anthe app, including its design, code, branding, icons, and all original content, is the intellectual property of Frederik Gielsen and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app without our prior written consent.

The name "Anthe" and associated logos are trademarks of Frederik Gielsen.

8. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim.
• We are not responsible for any loss or damage to plants, gardens, or other property resulting from reliance on information provided by the app, including AI-generated advice.

9. Termination

You may stop using the Service and delete your account at any time from Settings > Delete Account within the app.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms within the app and updating the "Last updated" date above. Your continued use of Anthe after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
